"It is not permissible for a Muslim who has something to bequeath to spend two nights without having his will written down with him."
The importance of the will
The Qur’an and the Sunnah teach us the status, importance, and wisdom of the Islamic will.
It is prescribed for you that when death approaches one of you – if he leaves behind any wealth – a bequest should be made in favor of parents and immediate family members[78] with fairness, this is a duty upon the righteous.
[78] This ruling was abrogated in Surah an-Nisā’, stipulating obligatory shares for parents and close relatives. Those who do not inherit by law may be remembered in a bequest.
Surah Al-Baqara
"It is not permissible for a Muslim who has something to bequeath to spend two nights without having his will written down with him."
Prophet Muhammad ﷺ
Sahih al-Bukhari 2738
"The soul of the believer remains suspended by his debt until it is settled."
Prophet Muhammad ﷺ

A Wassiya is a will prepared according to Islamic principles. It can record funeral wishes, debts, a preferred guardian for minor children, and voluntary bequests to non-heirs within the hadith-based one-third ceiling. Its legal effect remains subject to applicable law.
Legal validity depends on the law that applies where you live or hold assets. If French law applies and you use the holographic form, the testator must copy the complete text by hand, date it, and sign it; a printed PDF alone does not meet that form.
Witnesses are not required under French law for a holographic will. Islamic guidance on witnessing a will depends on the circumstances and scholarly interpretation, including Qur’an 5:106; qualified advice may be appropriate. Witnesses can also help confirm capacity and authenticity if a dispute arises.
